Law is notoriously complex. Can it be simplified?
Let’s contemplate the following thought experiment:
All laws are deducted from one rule:
Was there harm caused to someone or something? Harm can be defined as an undesired effect suffered.
If the answer is yes than the follow up question is: was it intentional or unintentional?
Unintentional: the person(s) responsible and accountable must be educated to prevent it from occurring again.
Intentional: there needs to be a clear understanding of:
- what was the motivation?
- were those accountable and responsible aware of the consequences?
- what incentivised this behaviour?
- what was hoped to be gained?
- how is the suffering of the victim justified?
